CLAIMS/REASSIGNMENT AND REEXAMINATION

SACHGEBIETE/INHALT:
Die den Rechtsstand eines Patentes verändern: Wechsel eines Patentinhabers (reassigment seit 1980),
nochmalige Prüfung eines Patentes und Effekt auf die Patentansprüche (reexamination seit 1981),
Verlängerung der gesetzlichen Laufzeit über 17 Jahre (extension seit 1980), Auslaufen wegen Nichtzahlens der
Jahresgebühr (expiration seit 1985).
CONTENTS/SUBJECTS:
U.S. patents reassigned since 1980, or reexamined since 1981. Reassignment occurs when ownership of a
patent is transferred from the original owner to another individual or company. Reexamined: patents reviewed
by the U.S. PTO at the request of a second party who has raised substantial new questions regarding the
patentability of the claims. Information about patents that have expired since 1985 because of non-payment of
required maintenance fees, and patents that have been granted extension beyond their normal 17-year life.
Extensions: when patents may have their normal 17-year term extended: This occurs primarily with
pharmaceutical patents for which the time needed for federal approval of a product has effectively shortened the
normal patent protection time period. Expirations: A patent expires when the normal maintenance fees are not
paid to the USPTO. Reinstatement: Expired patents may be reinstated if late payment of the maintenance fees
is accepted. For reassigned patents, the record includes the patent number, the former assignee, the new
assignee, the reassignment type (e.g. full interest, quarter interest, etc.), and date of reassignment, and reel and
frame number of the USPTO microfilm record. The record for a reexamined patent contains patent number, the
name of the party requesting reexamination, the location of the reexamination requestor, the assignee, the
reexamination request number and date, and the reexamination certificate date. Also included is the text from
the reexamination certificate describing the results of reexamination. Extension, expiration, and reinstatement
records include the patent number, the assignee, and expiration, extension, or reinstatement date; and date the
action was recorded in the Official Gazett of the USPTO. The reexamination, extension, expiration, and
reinstatement record are updated weekly with approximately 900 records per week. The reasignment record is
updated every two months with about 5000 records every two months. Reassignments covers 1980 - present;
Reexaminations covers Dec. 1981 - present; Expirations due to non-payment covers 1985 - present;
Reinstatements covers 1985 - present; Extensions covers 1986 - present.
